Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ReviewMyWeb’s websites, website review tools, reports, and related services (collectively, the “Services”). By using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

1. Eligibility and accounts

You must be at least 18 years old and capable of entering a binding contract. You are responsible for accurate account information, safeguarding your credentials, and activity under your account. Notify us promptly of unauthorized use.

2. Website reviews and authorization

You may submit only websites that you own, operate, or have permission to assess. You authorize us to access publicly available pages and technical resources at the submitted domain for the purpose of providing the Services. You must not use the Services to overload, disrupt, probe without authorization, or gain unauthorized access to any system.

3. Reports and recommendations

Reviews are automated assessments based on available information at a point in time. Results may be incomplete, contain errors, or change as a website, browser, network, or third-party service changes. Recommendations are provided for general informational purposes and are not legal, security, accessibility-certification, financial, or professional advice.

You remain responsible for evaluating recommendations, testing changes, and obtaining specialist advice when needed.

4. Acceptable use

You may not:

use the Services unlawfully or infringe another person’s rights;
submit malicious code or attempt to bypass access or usage controls;
reverse engineer, scrape, resell, or create a competing dataset from the Services except as permitted by law;
misrepresent report results or imply that ReviewMyWeb certifies compliance with any standard;
use automated means to access the Services beyond documented interfaces or limits; or
interfere with the integrity, security, or operation of the Services.

5. Fees, billing, and cancellation

Prices and included features are shown at purchase. You authorize applicable charges and taxes. Subscription plans renew automatically at the stated interval until canceled. You may cancel before renewal to avoid future charges; cancellation takes effect at the end of the current billing period. Except where required by law or expressly stated, fees are non-refundable.

6. Your content

You retain ownership of information and materials you submit. You grant us a limited, worldwide license to host, copy, process, and display that content as needed to provide, secure, and improve the Services. You represent that you have the necessary rights to provide it.

7. Our intellectual property

The Services, including software, design, branding, methods, and original content, are owned by ReviewMyWeb or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes.

8. Third-party services

The Services may depend on or link to third-party services. We are not responsible for third-party content, availability, security, or practices. Your use of third-party services may be subject to separate terms.

9. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or use the Services in a way that could harm us, our users, or third parties. Provisions that by their nature should survive termination will survive.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT RESULTS WILL BE ACCURATE, COMPLETE, OR ACHIEVE A PARTICULAR BUSINESS OUTCOME.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVIEWMYWEB WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to defend and indemnify ReviewMyWeb and its personnel from claims, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Services, your violation of these Terms, or your infringement of another person’s rights.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. The state and federal courts located in San Francisco County, California will have exclusive jurisdiction, unless applicable law requires otherwise.

14. Changes

We may update these Terms. We will post updated Terms and revise the effective date. Material changes will apply prospectively, and we will provide additional notice where required. Continued use after the effective date constitutes acceptance.
